Kleenheat Community Grants – Terms & Conditions

  1. TERMS AND CONDITIONS
    1. The Terms and Conditions of the Kleenheat Community Grants program 2023 (Program) comprise:

      1. These terms and conditions;
      2. The online Application Form to be completed by an Applicant is available at kleenheat.com.au/about/community/grants (Application Form).
    2. By participating in the Program, applicants and affiliated organisations or groups agree to be bound by the Terms and Conditions.
  2. OVERVIEW OF THE PROGRAM

    Subject to the Terms and Conditions:

    1. The Program is administered by Wesfarmers Kleenheat Gas Pty Ltd ABN 40 008 679 543 (Kleenheat) and will be offered in regional Western Australia and the Northern Territory.
    2. The Program intends to provide support via cash grants to organisations and not-for-profit community groups looking to enrich their communities through initiatives that fall into one of five categories: Connected Communities, Inspiring Bright Minds, Cultural Diversity, Health and Wellbeing and A Healthy Planet.
    3. An Applicant must be a registered not-for-profit organisation, community group, sporting club or charity to be eligible. They must also demonstrate they are of good character and standing, which supports the Program’s intent as outlined in Clause 2b.
    4. An Applicant must have an Australian Business Number (ABN).
    5. The Program opens for applications at 10:00 am (AWST) Sunday, 27 August 2023 and closes Sunday, 24 September 2023, at 5:00 pm (AWST).
  3. WHO CAN APPLY FOR A GRANT?
    1. An Applicant who meets each of the following criteria can apply for the Kleenheat Community Grants program:

      1. To be eligible, Applicants must meet the standards set out in Clause 2b, 2c and 2d;
      2. Individuals cannot apply. All applications must be submitted on behalf of a registered not-for-profit organisation. These include community groups, sporting clubs, and not-for-profit organisations. Applications will not be accepted from government organisations, political groups, grant-making or funding bodies, religious groups, organisations that partake in gambling, tobacco, alcohol or drug-related promotions or groups that discriminate based on ethnicity, age, gender, sexuality, impairment or beliefs;
      3. Applications must be from groups and organisations in regional Western Australia or the Northern Territory. Regional Western Australia includes the following regions: Gascoyne, Goldfields-Esperance, Great Southern, Kimberley, Mid-West, Pilbara, South West and the Wheatbelt. Peel and Perth Metropolitan regions are excluded.
    2. Employees of Kleenheat and any agencies associated with this Program and their immediate family are not eligible to apply for Kleenheat Community Grants. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child, parent, step-parent, brother, sister, step-brother, or step-sister. Kleenheat reserves the right to refuse any Application due to a conflict of interest as determined by Kleenheat in its absolute discretion.
  4. HOW TO APPLY FOR A GRANT
    1. To apply for a Kleenheat Community Grant, Applicants must submit an application during the Program open dates (see Clause 2e) by selecting a category and completing an Application Form at kleenheat.com.au/about/community/grants.
    2. No offline applications will be considered.
    3. Applicants may only submit one Application per organisation for each category.
    4. Incomplete or indecipherable applications may be deemed invalid at Kleenheat’s absolute discretion.
    5. Kleenheat accepts no responsibility for late, lost or misdirected applications (including where an application is not received due to technical difficulties).
  5. THE APPLICATION AND SUBMISSION
    1. By submitting an Application Form for a Kleenheat community grant, Applicants acknowledge and agree that:

      1. The Program is conducted at Kleenheat’s absolute discretion. If the Program is not completed as anticipated due to any reason, Kleenheat reserves the right, in its absolute discretion, to the full extent permitted by law to:

        1. disqualify any application, or
        2. modify, suspend, terminate or cancel the Program.
      2. There may be only one Application per organisation for each category;
      3. Kleenheat may contact an Applicant at any time concerning the Program during the open application period;
      4. There is no obligation for Kleenheat to promote, use or display any information provided in an Application, including images, logos or footage;
    2. Applicants acknowledge that by participating in the Program, they may, if requested by Kleenheat, be required to confirm or provide additional information regarding any Application (either by phone or email).
    3. By applying, Applicants represent and warrant that all information provided by them to Kleenheat in connection with the Program is true and correct and not misleading or deceptive by omission or otherwise.
    4. Kleenheat reserves the right, at any time, in its discretion:

      1. To verify the validity of applications (including the identities of applicants);
      2. To disqualify (at Kleenheat’s discretion) any application from the Program that does not follow the Terms and Conditions or which Kleenheat otherwise deems inappropriate; and
      3. To vary these Terms and Conditions, or to cancel, postpone or reschedule the Program.
  6. GRANT SELECTION PERIOD
    1. The Grant Selection Period will commence following the closing date of the Program (see Clause 2e).
    2. The Kleenheat Community Grants review committee (comprised of a select panel of Kleenheat employees) will review and assess each Application against set criteria. Selecting successful applicants will take up to eight (8) weeks. (See Clause 8 for further details).
  7. GRANTS
    1. Each Kleenheat community grant (Grant) must be used by the awarded Applicant towards the community initiative set out in their Application. Kleenheat reserves the right, at its absolute discretion, to request further information about any Grant that Kleenheat reasonably believes is not being used appropriately.
    2. As a condition of accepting the Grant, the awarded Applicant agrees to:

      1. Provide the information requested by Kleenheat regarding the initiative for which the Grant was intended, which may include photographs, quotes or video footage. Kleenheat may use this information during the Promotion Period (see Clause 10a) to create content media and digital channels to promote the Program;
      2. Use the Grant for the purpose detailed in the Application Form unless prior consent is obtained from Kleenheat (such consent will not be unreasonably withheld);
      3. Obtain Kleenheat’s consent before using any Kleenheat intellectual property, which includes the Kleenheat logo, or advertising any association with Kleenheat or participation in the Program;
      4. Participate in interviews, photography shoots and other activities to produce content to promote the Program. This content will be publicly available on social media, the Kleenheat website and other marketing channels.
  8. NOTIFICATION
    1. Upon closing (see Clause 2e for dates and times), the Kleenheat Community Grants Review Committee will commence a review and assessment of applications.

      1. Successful Applicants will be notified via email and phone up to eight (8) weeks from the closing date;
      2. Unsuccessful Applicants will be notified via email up to eight (8) weeks from the closing date.
      3. Successful applicants have up to thirty (30) days from notification to submit an invoice to receive their Grant. Failure to adhere to this deadline may result in forfeiting the collect their Grant.
    2. A list of successful Applicants will be published on the Kleenheat website at https://www.kleenheat.com.au/about/community/grants/recipients once all Grants have been received.
  9. LIABILITY
    1. Except for any liability that cannot be excluded by law, Kleenheat (including its officers, employees, and agents) excludes all liability of any nature, including negligence, and disclaims all responsibility for any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Program, including but not limited to, the following:

      1. The outcome of the Program;
      2. Any technical difficulties relating to applications;
      3. Any unauthorised access or third-party interference;
      4. Any application or Grant that is late, lost, altered, damaged or misdirected (as applicable) due to any reason beyond the reasonable control of Kleenheat;
      5. Any termination or cancellation of the Program;
      6. Any variation in Grant value to that stated in the Terms and Conditions.
  10. PRIVACY STATEMENT
    1. From the opening date specified in clause 2e indefinitely (Promotion Period), Applicants consent to Kleenheat using and displaying any information relating to them (including personal information as defined by the Privacy Act 1988 (Cth) and Privacy Act 1993 (NZ) (as applicable) (Personal Information) provided in an Application Form or otherwise collected from them during the Program, in any media without remuneration for the purposes of promoting and marketing the Program or any future Kleenheat program.
    2. Kleenheat may use and display such information for the purposes mentioned above online (including social media), external media, or in Kleenheat Branches, or otherwise make public any details at any time during the Promotion Period.
    3. All rights, title and interest in any such content will vest with Kleenheat.
    4. The Personal Information that the Applicants provide will be collected by Kleenheat to conduct the Program and managed under the Privacy Act 1988 (Cth) and Privacy Act 1993 (NZ) (as applicable) and Kleenheat’s Privacy Policy available at kleenheat.com.au/policies/privacy-policy. Participation in the Program is conditional upon providing this information. Kleenheat may disclose this Personal Information to its employees, contractors and agents to assist in operating the Program or communicating with Participants.
