Participation
  1. The promoter is Wesfarmers Kleenheat Gas Pty Ltd ABN 40 008 679 543 of Building 161, Car Park 12, Murdoch University, Murdoch WA 6150 (“Kleenheat”, “Promoter” or “we”).
  2. Instructions on how to enter and other details contained within promotional, electronic and print materials form part of the terms and conditions. These terms and conditions prevail to the extent of any inconsistency with the content of any such materials. By participating in this competition, entrants are deemed to agree to these terms and conditions.
  3. To be eligible to enter (“Eligible Entrant”), you must:

    • be a resident of Western Australia;
    • be a current Flybuys member or valid new Flybuys member who joins during the Promotional Period (to be a valid Flybuys member the Flybuys member account must include the member’s first and last name, a postal address, an email address and a contact phone number current at time of draw and prize distribution);
    • be 18 years of age or over;
    • not be an employee (or an immediate family member of an employee) of Kleenheat, its agencies or any organisation associated with the promotion. For the promotion, “immediate family member” includes spouse, de-facto spouse, and natural, adopted or a stepchild who lives in the same household as the employee; and
    • sign up for the Kleenheat Monthly Energiser Plan and link their Flybuys membership number to their Kleenheat account via kleenheat.com.au/flybuys-win within the ‘Promotional Period’.

    Existing Kleenheat natural gas customers are not eligible to participate in the competition.

  4. We may (in our absolute discretion):

    • verify an entrant’s identity, age and the validity of entry;
    • disqualify entrants who submit an entry that is not in accordance with these terms or who tampers with the entry process;
    • disqualify entrants who enter using multiple aliases;
    • accept or reject entries that contain errors or omissions; and
    • deem incomplete, plagiarised, defamatory or indecipherable entries invalid.
  5. The ‘chance to win a share of 10 million Flybuys points’ competition commences at 12:01 am (AWST) on Thursday, 22 February 2024, and ends at 11:59 pm (AWST) on Sunday, 5 May 2024 (“Promotional Period”).
    6. Entering
  6. ‘Eligible Entrants’ who sign up for the Kleenheat Monthly Energiser plan and link their Flybuys membership number to their Kleenheat account via kleenheat.com.au/flybuys-win will automatically receive one entry into the competition.
  7. Information about entrants may also be used by Kleenheat, its agents, contractors, and related companies, for other purposes as set out below. By participating in the competition, entrants consent to these uses and disclosure of their information.
    8. Prize
  8. The prize structure comprises:

    • 1st (x1): 2,000,000 Flybuys points (valued at up to $10,000)
    • 2nd (x4): 500,000 Flybuys points (valued at up to $2,500 each)
    • 3rd (x75): 80,000 Flybuys points (valued at up to $400 each),

    (each a “Prize”).

  9. All Prizes must be taken as offered and may not be transferred or substituted except at Kleenheat’s discretion and subject to State or Territory legislation. The Prize is not redeemable for cash. However, Kleenheat reserves the right to substitute a prize of equal or greater value where necessary due to Prize unavailability. Any tax on the Prize is the responsibility of the winner. Independent financial advice should be sought by any person participating in this competition.
  10. A condition of accepting the Prize is that the winner must comply with all the conditions of use of the Prize and the Prize provider’s requirements. Flybuys point prizes are subject to the terms detailed at https://experience.flybuys.com.au/flybuys-terms-and-conditions/
  11. If, for any reason, a winner is not able to participate in or accept the Prize or the winner does not take the Prize at the time stipulated by the Promoter or the Prize provider, the Prize will be forfeited.
    12. Drawing winners
  12. The Prize draw will occur at 10.00AM (AWST) on Wednesday 8 May 2024, at Wesfarmers Kleenheat, Building 161, Car Park 12, Murdoch University, Murdoch WA 6150.
  13. The Promoter will draw eighty (80) winners (the “Winners”) from the pool of ‘Eligible Entrants’
  14. The first (1st) valid entry drawn will win the First (1st) Prize, the next four (4) valid entries drawn will each win a Second (2nd) Prize and the next seventy-five (75) valid entries drawn will each win a Third (3rd) Prize, subject to the Promoter’s rights under point 4.
  15. Prize winners will be notified via email within seven (7) days of the draw. Kleenheat will take all reasonable steps to notify the winners.
  16. Each Flybuys points prize will be automatically allocated to the Winner’s Flybuys account provided as per the Kleenheat account application 14 days after the draw date.
  17. The Winners’ details will be published at kleenheat.com.au/about/competition-winners, within seven (7) days of the draw.
  18. The Promoter may request that the Winners provide proof of identity, proof of age or proof of residency to the Promoter’s reasonable satisfaction before awarding the prize. If upon request a winner does not provide proof of identity, proof of age or proof of residency to the Promoter’s reasonable satisfaction within 90 days after being selected as a winner, then the relevant Winner may be deemed to have forfeited their entitlement to their prize.
  19. If for any reason, any of the Prizes have not been awarded within 90 days after the draw date the Promoter may conduct a further draw (“unclaimed Prize draw”) from the pool of valid entries at 10:00am (AWST) on Tuesday 6 August 2024, at Wesfarmers Kleenheat Gas Pty Ltd ABN 40 008 679 543 of Building 161, Car Park 12, Murdoch University, Murdoch WA 6150.
  20. The first valid entry the Promoter draws is the winner of the unclaimed Prize draw, subject to the Promoter’s rights under point 4. If two or more prizes are included in the unclaimed Prize draw, the second valid entry drawn will win the second available prize, the third valid entry drawn will win the third available prize, and so on, until all available prizes have been allocated.
  21. Subject to applicable regulatory requirements, in the event of a dispute regarding these terms and conditions, the decision of the General Manager of Kleenheat will be final and binding, and no correspondence will be entered into.
    22. Changing the competition
  22. If any act, omission, event or circumstance occurs which is beyond the reasonable control of Kleenheat and which prevents it from complying with these terms and conditions, Kleenheat will not be liable for any failure to perform or delay in performing its obligations and Kleenheat reserves the right (subject to compliance with regulatory requirements) to cancel, terminate or modify or suspend this promotion.
    23. Liability
  23. To the extent permitted by law, we (and our officers, employees and agents) and Loyalty Pacific Pty Ltd (“Flybuys”) are not liable for any loss, expense, damage or liability suffered or incurred by you in connection with the competition, including:

    • any late, lost, incomplete, incorrectly submitted, delayed, illegible or misdirected entries;
    • any technical difficulties or equipment malfunction;
    • any theft, unauthorized access or interference by another person;
    • any entry or Prize claim that is late, lost, altered, damaged or misdirected;
    • any variation in Prize value to that stated in these terms;
    • any tax liability incurred by you;
    • use of, or taking of, a Prize; or
    • participation in the competition.
    24. Privacy
  24. The entrants’ personal information will be collected by or on behalf of Kleenheat to administer the competition and publicise the Prize winners. If we do not collect your personal information, then we will not be able to process your entry in the competition. The personal information of:

    • the Prize winners may be provided to others assisting in the conduct of the competition, including but not limited to the competition administrator and Flybuys, and their agents, to the extent necessary for Prizes to be delivered to the Prize winners and for Flybuys to send winner notification emails, and to regulatory authorities. Flybuys uses and manages entrants’ personal information in accordance with its privacy policy. Kleenheat will disclose the Prize winner’s first initial, surname, suburb and State/Territory of residence online, and will publish these details at kleenheat.com.au/about/competition-winners at the conclusion of the competition. An entrant also agrees that Kleenheat may, in the event the entrant is the winner, publish or cause to be published the entrant’s name and postcode in any media, as required under the relevant State or Territory lottery legislation; and
    • entrants may be provided to external service providers bound under confidentiality agreements which are engaged by Kleenheat for the purposes of the competition.
  25. By participating in the competition, winners consent to Kleenheat using their (and their companions) name, likeness, image and/or voice (including any photograph, film and/or recording of them) in any media at any time or times and agree to grant Kleenheat a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners (and their companions) will not be entitled to any fee for such use to promote this competition and Kleenheat. Kleenheat and the are entitled to amend, edit, select, crop, retouch or add to the image and to reproduce it in any form or media whatsoever throughout the world.
  26. All personal information collected by Kleenheat under this competition is handled in accordance with Kleenheat’s Privacy Policy which can be found at www.kleenheat.com.au/privacy. Details on how to:

    • gain access to your personal information in our possession;
    • correct personal information in our possession; or
    • make a complaint about Kleenheat’s handling of your personal information,

    are contained in that Privacy Policy. Should you wish to be removed from Kleenheat’s direct marketing database, or stop receiving direct marketing material from Kleenheat, you can contact Kleenheat on 13 21 80 or (in the case of email or SMS communications) unsubscribe using the method set out in the relevant message.

# Flybuys Dollars: Flybuys points can be converted to Flybuys Dollars in multiples of 2,000 points only. Every 2,000 points equates to $10 Flybuys Dollars. Flybuys Dollars may be used in-store only at Coles Supermarkets, Coles Express, First Choice Liquor Market, Kmart, Liquorland, Officeworks, Target and mycar. Physical Flybuys card must be presented at checkout. Flybuys points and Flybuys Dollars have no cash or monetary value.
