The promoter is Wesfarmers Kleenheat Gas Pty Ltd ABN 40 008 679 543 of Building 161, Car Park 12, Murdoch University, Murdoch WA 6150 (“Kleenheat” or “we”).
These terms and conditions apply to the Perth Good Food and Wine Show, Kleenheat Customer 2-for-1 ticket offer. (“Promotion”).
The intent of the Promotion is to provide Kleenheat customers with the opportunity to purchase ‘two tickets for the price of one’ to the Good Food and Wine Show Perth, which is taking place Friday 19 July 2024 to Sunday 21 July 2024 (“Event”).
Instructions on how to participate, ticket details and other information contained within promotional materials prepared and issued by Kleenheat in relation to the Promotion form part of these terms and conditions to the extent that they are not inconsistent with the terms and conditions set out in this document.
By participating in the Promotion, participants are deemed to agree with these terms and conditions.
To be eligible to participate in the Promotion (“Eligible Entrant”), you must:
1. be a resident of Western Australia;
2. be 18 years of age or over; and

Delivery of Tickets

Your tickets will be delivered electronically via email (e-tickets).

If there is $0, or no value in ‘Fees’ column or fields, that means there are no fees applicable to your purchase.

Refund and Returns

We are not responsible for any refunds or returns of any tickets to the Event whether acquired under the Promotion or otherwise.
Refunds and returns are covered under the policy of the Event Organiser, and do not limit your rights under Australian consumer law.

1. All transactions are final. No refunds are permitted, except as required by law.

If any act, omission, event, or circumstance occurs which is beyond the reasonable control of Kleenheat and which prevents it from complying with these terms and conditions, Kleenheat will not be liable for any failure to perform or delay in performing its obligations and Kleenheat reserves the right (subject to compliance with regulatory requirements) to cancel, terminate, modify or suspend the Promotion at any time and without notice.

Liability

To the extent permitted by law, we (and our officers, employees, agents and representatives) are not liable for any loss, expense, damage or liability suffered or incurred by you in connection with the Promotion, including:
1. not receiving a unique URL to participate in the Promotion;
2. any technical difficulties or equipment malfunction;
3. any theft, unauthorised access or interference by another person;
4. any ticket to the Event that is late, lost, altered, illegible, damaged or misdirected;
5. any tax liability incurred by you;

7. attending and/or participating in the Event; or
8. participation (or failure or inability to participate) in the Promotion.

Participation

Instructions on how to enter and other details contained within promotional, electronic and print materials form part of the terms and conditions. By participating in this competition entrants shall be deemed to agree to abide by these terms and conditions. These terms and conditions prevail to the extent of any inconsistency with the terms and conditions set out in any such materials.
To be eligible to enter (“Eligible Entrant”), you must:
1. be a resident of Western Australia
2. be 18 years of age or over; and
3. not be an employee (or an immediate family member of an employee) of Kleenheat, its agencies or any organisation associated with the promotion. For the purposes of the promotion, “immediate family member” includes spouse, de facto spouse and natural, adopted or a step child who lives in the same household as the employee.
We may (at our absolute discretion):
1. verify an entrant’s identity, age and the validity of entry;
2. disqualify entrants who submit an entry that is not in accordance with these terms or who tampers with the entry process;
3. disqualify entrants who enter using multiple aliases;
4. accept or reject entries that contain errors or omissions; and
5. deem incomplete, plagiarised, defamatory or indecipherable entries invalid.
The competition commences at 10:00 am (WST) on Monday 29 May 2023 and concludes at 5:00 pm (WST) on Sunday 13 August 2023 (“Entry Period”).

Entering

To enter the competition, an Eligible Entrant must log on to kleenheat.com.au/about/community/good-food-wine-show/competition (“the Entry Form”) during the Entry Period and follow the instructions to fully and correctly complete and successfully submit the online Entry Form.
Entry is limited to one unique entry per Eligible Entrant.
Automated or robotic entries submitted by individuals or organisations will be disqualified.
The promoter is not responsible if the Eligible Entrant’s mobile device/desktop is not sufficiently capable for the purpose of submitting an entry.
Upon receipt, entries become the property of Kleenheat. Information resulting from the entrant’s entry and participation in the promotion is used by Kleenheat for the determination of the Prize winner and to contact the entrant about Kleenheat’s products (unless and until the entrant informs Kleenheat that the entrant no longer consents to be contacted about Kleenheat’s products). Information about entrants may also be used by Kleenheat, its agents, contractors and related companies for other purposes as set out below. By participating in the competition, entrants consent to these uses and disclosure of their information.

Prizes

There is one (1) prize (“Prize”) to be won, as described below:

The total Prize pool is valued at $6,220.40 (AUD), including GST.
The prize must be taken during specified dates – flights depart Thursday 7 September 2023, and return Monday 11 September 2023; accommodation is from Thursday 7 September 2023 to Monday 11 September 2023 and is based on two (2) people sharing one (1) room; and the Shinju Matsuri 2023 Sunset Long Table Dinner is on Saturday 9 September 2023.
Specified accommodation and event tickets are subject to availability when booking. Alternatives may be offered dependent on availability.
The Prize winner and their travelling companion are responsible for all other expenses including spending money (unless specified), meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (excluding departure and any other flight associated taxes included within the prize), energy surcharges, gratuities, services charges and all other ancillary costs. Travel insurance is not included (unless specified in the prize inclusions) but is highly recommended.
All Prizes must be taken as offered and may not be transferred or substituted except at Kleenheat’s discretion and subject to State or Territory legislation. Save for any stated cash component of the Prize, the Prize is not redeemable for cash. However, Kleenheat reserves the right to substitute a prize of equal or greater value where necessary due to Prize unavailability. Any tax on the Prize is the responsibility of the winner. Independent financial advice should be sought by any person participating in this competition.
It is a condition of accepting the Prize that the winner must comply with all the conditions of use of the Prize and the Prize provider’s requirements.
If, for any reason, a winner is not able to participate in or accept the Prize or the winner does not take the Prize (or an element of the Prize) at the time stipulated by the promoter, the Prize (or that element of the Prize) will be forfeited. In those circumstances, cash will not be awarded in lieu of the Prize or that element of the Prize.

Selecting a winner

The winner will be selected in a random drawing (“Draw”) from among all valid entries received throughout the Entry Period. Odds of winning will vary depending on the number of valid entries received.
The Prize draw will occur at 11:00am (WST) on Wednesday, 16 August 2023 at Wesfarmers Chemicals, Energy & Fertilisers Pty Ltd, Building 161 Campus Drive, Murdoch University, Murdoch WA 6150.
The winner will be notified via email or phone within three (3) days of the Draw. Kleenheat will take all reasonable steps to notify the winner.
To redeem the prize, the winner must respond to the prize notification email from Kleenheat by 12:00PM (WST) 14 days from the day of notification to claim the Prize (“Notification Period”).
The Prize winner’s details will be published at kleenheat.com.au/about/competition-winners within three (3) days of the Draw.

Alternative winner

In the event of the winner failing to or being unable to satisfy these terms and conditions or forfeiting or not claiming the Prize within the Notification Period, an unclaimed Prize draw will be conducted at Wesfarmers Kleenheat Gas Pty Ltd, Building 161, Car Park 12, Murdoch University, Murdoch WA 6150 at 2.00 pm (WST) on Wednesday 13 September 2023. In this eventuality, the alternative Prize winner will be notified via phone or email within two (2) business days of the unclaimed Prize draw. The winner’s details will be published on the website.

Other conditions applicable to the Prize

Once confirmed in writing, travel dates and names of those travelling are not changeable without incurring extra fees. Neither Kleenheat nor the prize provider accepts any responsibility for fees incurred due to any changes made, and these costs will be borne by the winner and/or their companion/s.
The Prize winner and their travelling companion must travel simultaneously, depart from Perth, and be responsible for transport from their residence to Perth airport for flight departure. The Prize winner is responsible for organising transfers and covering associated costs to and from the winner and their travelling companion’s residence.
Air tickets are available on the regularly scheduled services of each airline and are subject to seasonal embargos. Kleenheat has the right to determine the airline carrier at its discretion. If a winner requests a specific carrier not offered by Kleenheat, any subsequent or additional fees and taxes, if applicable, will be the responsibility of the winner. Flight itineraries may have to be adjusted depending on the airline’s departure city and current flight schedule. Frequent Flyer points are not available from any airline. Kleenheat is not responsible for the cancellation, delay or rescheduling of any part of a travel Prize and any costs incurred by the winner or any travelling companion as a result (including accommodation costs) will be the responsibility of the winner.
All components of the Prize must be fulfilled simultaneously and cannot be split across different periods. All package elements are subject to availability at the time of booking.

Disputes

In the event of a dispute regarding these terms and conditions, the decision of the General Manager of Kleenheat will be final and binding, and no correspondence will be entered into.

The entrants’ personal information will be collected by or on behalf of Kleenheat to enable it to administer the competition and publicise the Prize winners and to enable it to inform you of products and services that may be of interest to you, including by way of direct marketing. If we do not collect your personal information, we cannot process your entry in the competition. The personal information of:
1. the Prize winners may be provided to others assisting in the conduct of the competition, including but not limited to the competition administrator, the Prize provider, and their agents, to the extent necessary for Prizes to be delivered to the Prize winners, and to regulatory authorities.
